PRIVACY POLICY & TERMS OF SERVICE Privacy Policy Information submitted relating to and/or regarding Terror Film Festival will be treated in accordance with the Terror Film Festival Terms and Conditions and Terms of Service, and the Terror Film Festival privacy policy herein, provided that in the event of any conflict between the Terms and Conditions and Terms of Service and such privacy policy, the Terms and Conditions and Terms of Service shall prevail. All contestants and their associates hereby acknowledge and agree that Terror Film Festival will have access to some and/or all of their personally identifiable information, including but not limited to, registration information collected by Terror Film Festival. With all that said, Terror Film Festival does its best to not release your information unless it has the potential of benefiting you and your project. Terms of Service First and foremost, submitting your film and/or screenplay to Terror Film Festival (TFF) in no way implies ANY ownership rights by TFF to the submitted film and/or screenplay. We do not own your film and/or screenplay, you do. And submitting your film and/or screenplay to TFF does not change that. Which means you can submit your film and/or screenplay to anywhere else in the world, as well. In fact, we encourage you to get your film and/or screenplay out there for people to see. Every screenplay and film submitted to TFF is done so on a NON-exclusive basis. All filmmakers and/or volunteers and/or participants agree to be legally bound by these rules, terms, and conditions, if You choose to submit any material(s) and/or information to, or choose to participate in, TFF, and/or associate with TFF in any way. All festival screening decisions will be made solely by Terror Film Festival. All Terror Film Festival decisions are final. ALL of your submission entry items (entry fee, TWO copies of your Film or Screenplay, application form) must be POSTMARKED by the deadline date that you're trying to submit by, in order to qualify for that deadline date, and it all must be RECEIVED by TFF before your film and/or screenplay can be considered "submitted". TFF does not return your materials, so please do not send us your master copies. TFF does not consider any incomplete films or screenplays, or works-in-progress. At TFF's sole discretion, TFF does not screen any works that include hardcore pornography, real-life cruelty to humans or animals, illegal acts, or hate. Please clearly label ALL materials submitted with at least the project title, your email address, and your TFF number if submitted through withoutabox. Film selections, screenplay selections, and award nominees, are posted on the TFF website approximately six weeks before the festival, and any further needed materials will be requested at that time. Claw Award Winners are posted the week following the festival run. Only one movie per DVD or VHS, and only one film or one screenplay per application. If entering more than one movie or screenplay, you must submit each separately. Even if it's a fantastic epic trilogy! Each movie and screenplay is judged solely on its merits. TFF accepts original and/or adapted films in the horror, fantasy, science fiction, thriller, or drama genres. Screenplays can be any genre. TFF cannot grant waivers for fees or deadlines at any time. Please do not ask. We hate saying no, we feel bad saying no, and we don’t like the word no, but the answer must remain no. By submitting a movie to this competition you agree that, if your film is selected by TFF, then TFF is permitted to screen your movie publicly during TFF in the current year of your submission, and that TFF is permitted to use excerpts from your movie, still photos, artworks and images for current and future promotion, marketing and advertising of TFF and TFF festival related events, NON-exclusively. So feel free to submit to any other festival out there, as well. By submitting a screenplay to this competition you agree that, if your screenplay is selected by TFF, then TFF is permitted to use the title and author’s name for promotional reasons. By submitting a film and/or screenplay, you also authorize TFF to place your images and synopsis on our website, so make sure your films and screenplays are copyrighted with the Library of Congress and/or registered with the WGA! Films and screenplays are reviewed by TFF with the intention of selecting screeners and winners for the festival and the work will not be divulged to any persons not affiliated with TFF, unless first permitted in writing by the author/owner of the work. Fees. All fees and/or payments paid to TFF are non-refundable. All payments to TFF must be made payable to “TERROR FILM FESTIVAL”. Domestically, TFF accepts checks, money orders, and online payments, in US Dollars only. Payments from outside the USA must be paid either online, by certified check, or by international money order, in US dollars only. No exceptions!! TFF accepts cash only at the event door for ticket purchases and merchandise sales. Pre-Selection and Exhibition Screeners. Do not send TFF any master copies of anything. TFF does not return any material(s). Your Information. You will ensure that all of the material and/or information submitted by You to TFF is accurate, legitimate, up-to-date, and timely. It is YOUR RESPONSIBILITY to ensure the accuracy of your information. You will further ensure that all material and/or information pertaining to yourself or your submitted material(s) and/or information are entirely consistent with any other material(s) and/or information you submit to TFF, including material(s) and/or information You post on Your own website(s) or any other public notice that you initiate relating to and/or regarding TFF. Any material(s) and/or information and/or person(s) may be withheld and/or refused and/or not used and/or rejected and/or denied by TFF from any portion of TFF and/or its pre and/or current and/or post processes and/or events and/or activities at any time at TFF’s sole discretion. Property Rights. Except as explicitly set forth herein, each party's trademarks, copyrights, patents, trade secrets and intellectual property rights ("Intellectual Property") are and shall remain the sole property of that party. Performance and Permission to Use. By submitting your film and/or screenplay to this competition you agree that, if your film and/or screenplay is selected by TFF, You grant to TFF a NON-exclusive license to use, display, exploit and exhibit Your name, trade names, trademarks, service marks, copyrights, still images, moving images, audio sounds, your submitted film and/or screenplay, material, information, and/or any other things received by TFF, whether by physical or electronic delivery (including material and/or material(s) here, and above and below herein), publicly, at TFF’s sole discretion. You further agree that TFF is permitted to use excerpts from your film and/or screenplay for promotion, marketing and advertising of TFF and TFF events. Further, non-performance of any party shall be excused to the extent that performance is rendered impossible by strike, fire, flood, earthquakes, war, governmental acts or orders or restrictions, acts of God, physically defective product/equipment, or any other reason where failure to perform is beyond reasonable control, and not caused by the negligence of, the non-performing party.

Confidentiality. TFF agrees to use its best efforts and judgement in not releasing any personal and/or confidential information about any filmmaker and/or their material(s) and/or information. You agree to not release any material(s) and/or information regarding TFF or any of its staff, associates, or affiliates, either verbally or in writing, in any derogatory and/or defamatory and/or negative manner. Any materials received by TFF that contain real-life cruelty to humans or animals, illegal acts, or hate will be delivered to the appropriate authorities. TFF will not promote cruelty or hate. Public Statements. Either party may use the other party's name for the purpose of making public statements such as press releases and marketing and promotional materials, provided that each party adheres to reasonable good faith and consideration standards for making such statements. In all cases, full consideration and representation of the respective roles and contributions of both parties shall be given in any such statement. You agree not to use any reference to TFF in any pornographic, illegal, abusive, defamatory, offensive, or negative way whatsoever. Partnership and Employment. Submitting material(s) and/or information, volunteering, or participating in anyway regarding TFF whatsoever in no way implies or constitutes employment or a partnership of any kind. Purchasing Obligations. Accepting these Terms and Conditions is not an acknowledgment of any purchase, nor does it obligate You or TFF to make any purchase. It merely sets the terms of service and agreement should You decide to submit any material(s) and/or information to, or participate in, TFF. Responsibility and Liability. Neither party shall owe any liability to the other party arising under this agreement for any indirect, special, punitive or consequential damages, including, without limitation, loss of profit or business opportunities, except as expressly set forth herein. Neither party makes (and each party hereby specifically disclaims) any, representations or warrantees, express or implied, regarding the services contemplated by this agreement, including any implied warranty of merchantability or fitness for a particular purpose, implied warranties arising from a course of dealing or course of performance or any warranties relating to title or non-infringement of intellectual property. Neither party makes any representation, warranty or assurance concerning any minimum or maximum number of viewers or attendees or screenings or celebrities or special guests or events or seminars. Except for payments due collected by TFF as stated herein or on TFF’s website(s), TFF’s liability for any damages caused to You as a result of performance or non-performance or damage under, or not under, this agreement shall be limited in all circumstances to an amount no greater than one U.S. dollar ($1.00). Further, You agree to not hold TFF liable for any reason whatsoever, and to not bring or incite any legal action(s) against TFF for any reason whatsoever. Neither TFF, TFF judges, organizers, employees, sponsors, participating organizations, assume any responsibility for any damage to or any loss of any material(s) submitted. Further, TFF does not assume any responsibility for any damage whatsoever to any person(s) participating in and/or attending any event associated with TFF. It is Your sole responsibility as a TFF submitter to secure permission to use any copyrighted materials in your submitted film and/or screenplay. You are responsible for all aspects of your movie and/or screenplay. TFF does not and will not accept any responsibility of any kind whatsoever for any legal action(s) brought against your movie or your screenplay. Please make sure your paperwork is in order before submitting. Furthermore, TFF attempts to remain servicing 24/7. However, acts of God do happen. In any situation, if anything negative or unwanted happens involving TFF, TFF will not be expected by You to be liable or responsible for the damage in anyway whatsoever, regardless of how severe the damage. Further, TFF will not be expected by You to be liable or responsible in anyway whatsoever should TFF or the TFF website not be accessible to You. Furthermore, TFF will not be expected by You to be liable or responsible in anyway whatsoever for any person(s), or personal or professional items, that are stolen or damaged while either in, or not in, the possession of TFF, in perpetuity. However, TFF promises to treat every unfortunate incident with concern, and a commercially reasonable effort will be made to remedy the situation at TFF's sole discretion. Every precaution will be exercised in handling entries, but neither TFF, TFF judges, organizers, employees, sponsors, participating organizations, or associates assume any responsibility for any damage to or any loss of any material(s) or information submitted. TFF does not assume any responsibility for any damage whatsoever to any person(s) participating in and/or attending any event associated with TFF. Participation in and/or attending TFF implies understanding and acceptance of all TFF terms, conditions and rules. Not adhering to TFF terms, conditions and rules is cause without prior notice for disqualification from TFF and/or from being selected by TFF, and TFF reserves the right to select and/or not select and/or disqualify any submitted materials, and refuse admission of any person(s) and/or material(s) to any TFF activity and/or event at TFF’s sole discretion. Governing Law. This Agreement shall be governed by and construed in accordance with the laws of the State of Pennsylvania, without regard to the choice of law principles. This Agreement is entered into in Philadelphia, Pennsylvania, and any action brought to enforce the terms of this Agreement shall be brought in a court of competent jurisdiction in Philadelphia County, Pennsylvania. All attending person(s) must be 21 years or older to attend any TFF event where liquor will be available. Further, TFF and the TFF Terms and Conditions and the TFF General Rules are governed by and shall be construed in accordance with the laws of the Commonwealth of Pennsylvania, United States of America, without regards to its principles of conflicts of law, in perpetuity. For any dispute not subject to arbitration, entrant agrees to personal jurisdiction by the federal and state courts located in Philadelphia, Pennsylvania, United States of America, and waives any jurisdictional, venue, or inconvenient forum objections to such courts. Further, in any such dispute, under no circumstances will entrant be permitted to obtain awards for, and hereby irrevocably waives all rights to claim, punitive, incidental, or consequential damages, and/or any other damages, including attorneys' fees, other than participant's actual out-of-pocket expenses (i.e.- costs associated with participating in the festival competition), and entrant further irrevocably waives all rights to have damages multiplied or increased, in perpetuity. All federal, state, and local laws and regulations apply. All taxes on or connected with any prize and the reporting consequences thereof, are the sole and exclusive responsibility of respective winners. Furthermore, by entering TFF, all entrants agree to the complete contents of the TFF Terms and Conditions and the TFF General Rules. All entrants release and agree to hold TFF and/or all other TFF related entities harmless from and against any and all injuries, rights, damages, losses, claims and actions of any kind arising in whole or in part, directly or indirectly, from TFF or participation in TFF and any TFF related activity, in perpetuity. All entrants release and waive any claims with regard to TFF and agree to hold harmless TFF and/or all TFF related entities from and against any and all claims of any kind that are or could be asserted with respect to any matter whatsoever, in perpetuity. All entrants further agree to indemnify, defend against and agree to hold harmless TFF and/or all other TFF related entities from any and all liabilities, damage, costs and/or fees incurred in defending against any third party claim(s) or threat(s) of claim(s) asserted against TFF and/or all other TFF related entities arising from any entrant’s participation in or conduct associated with TFF, in perpetuity. Miscellaneous. All information by TFF, whether publicly posted or not, is subject to change without prior notice. TFF does not return your materials so please do not send us your master copies. In conclusion, we’re all filmmakers here at TFF, and we understand the trials and tribulations of a low-budget shoot and the workings of a major studio shoot. And in the end, we feel what makes a great film is not spectacular SFX, great lighting, the budget, or a truckload of celebrities. It’s talent, vision, tenacity and grace. Therefore, we place no limitations on your experience level as a filmmaker or screenwriter, nor any limitations on your status in the entertainment industry. Further, your project does not get selected based on your distributor calling us, your agent calling us, or your Mom calling us. It gets selected based solely on its entertainment value and its execution. So make a GREAT film and write a GREAT screenplay. Because at TFF, we reward talent.
